These Terms and Conditions ("Terms") govern your access to and use of Attenda, operated by E&L Asia Pacific Limited ("we", "us", "our"). By creating an account or using Attenda you agree to these Terms. If you do not agree, do not use the service.
Key points: You are responsible for the data you collect from event participants. Export your data before it is deleted. We are not liable for losses arising from failure to export. Governing law is Hong Kong.
Attenda is a web-based platform that allows event organisers ("Organisers") to manage event attendance and collect digital signatures from participants. We provide the technology platform only. We are not responsible for the events themselves or for the legal validity of signatures collected through the platform under any particular jurisdiction's laws.
To use Attenda you must create an account with a valid email address. You are responsible for:

As an Organiser you are the data controller for all participant data you collect through Attenda. You are solely responsible for:
We provide a consent text feature on the signature capture screen to help you inform participants. Use of this feature does not guarantee legal compliance. You remain responsible for ensuring appropriate consent is obtained.
Event participant data including signatures is automatically deleted after the following periods:
You will receive an automated reminder before deletion. It is your responsibility to export any data you wish to retain before it is deleted. We are not liable for any loss arising from failure to export data before deletion.
Account data is retained for the duration of your account and deleted within 30 days of account closure.
Paid plans are billed in advance. All prices are in USD unless otherwise stated.
Per-event purchases are non-refundable once the event has commenced. If you have not yet started the event and have not accessed the kiosk, contact us within 24 hours of purchase for a refund consideration.
Annual subscriptions are billed yearly and renew automatically. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of an annual subscription.
Where a free trial is offered, no charge is made during the trial period. You may cancel before the trial ends to avoid being charged. We reserve the right to modify or discontinue free trials at any time.
If a payment fails your account will be downgraded to the free plan. Data associated with paid features remains accessible for 7 days to allow you to export it or resolve the payment issue.
Attenda and all associated software, designs, and content are the intellectual property of E&L Asia Pacific Limited. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the service as described.
You retain ownership of all data you upload to Attenda. By uploading data you grant us a limited licence to process it solely for the purpose of providing the service.
To the maximum extent permitted by applicable law, E&L Asia Pacific Limited shall not be liable for:
Our total liability to you for any claim arising from use of Attenda shall not exceed the amount you paid us in the 12 months preceding the claim.
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications to the service at any time. We will endeavour to provide advance notice of planned downtime where possible.
We may suspend or terminate your account if you breach these Terms, if your payment fails and is not resolved within 7 days, or if we determine your use of the service poses a risk to other users or to the platform.
You may close your account at any time by contacting us at info@getattenda.com. Upon closure all your data will be deleted within 30 days.
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of Attenda after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms or your use of Attenda shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
